Probate is the legal process through which property is transferred when a person dies. The purpose of probate is to formalize the decedent’s intentions relative to the distribution of his or her property after death. This is typically accomplished with a will, but any property or assets not disposed of through a will or right of survivorship will be disposed of by the probate court according to state probate laws.

Normally, the decedent has appointed an executor to manage affairs after his or her death. In cases in which the decedent has failed to designate an executor, the court will appoint an administrator to settle the estate.
