Armed Services Board of Contract Appeals Lawyers
The Armed Services Board of Contract Appeals (ASBCA) is a unique forum that has jurisdiction to decide any appeal from a final decision of a contracting officer at the Department of Defense (DoD) or National Aeronautics and Space Administration (NASA) under the Contract Disputes Act (41 U.S.C. §§ 7101-7109). Because the rules allow a contractor to represent themselves, one of the most frequent and biggest mistakes contractors make when disputing a contracting officer’s decision is filing in the wrong place or at the wrong time. The ASBCA is the initial place to appeal a Department of Defense or NASA contracting officer’s denial of a claim, request for equitable adjustment, change order, or other construction or contract dispute, including bid solicitation issues, terminations for default, and delay claims. DBL’s Armed Services Board of Contract Appeals lawyers work closely with our government contracts lawyers and other litigation teams to help ensure our clients know all of their options. Often the ASBCA’s alternative dispute resolution is a useful tool, but if not, we will help you make the determination. Whether it is pursuing a claim in the United States Court of Federal Claims or the ASBCA, DBL is committed to:
- Immediate prompt replies for administrative law matters due to the short turn-around times and deadlines;
- Detailed case analysis and fact investigation to make sure the claims are brought timeline, in the right place, and with the correct information; and
- Cost-efficient – our offices in Vienna, Virginia, are just a few miles from the ASBCA’s office in Falls Church, Virginia, where all hearings are held, and similarly proximate to the Court of Federal Claims in Washington, D.C.
The Rules of the ASBCA can be found here: Rules of the ASBCA. Many of the filing requirements have been updated during COVID (see e.g. Document Filing Guidance (7 April 2020), and General Guidance for Proceedings Conducted Using Video-Conferencing (28 August 2020).
