Copyright Counseling and Infringement Litigation

The proliferation of content in the form of blogs, YouTube videos, and other media on a global scale has created a landscape constantly in flux. Artists, photographers, authors, companies and a host of other media creators are faced with the challenge of constantly protecting and defending their intellectual property from others. See our blog on Intellectual Property Theft. We help clients understand what they can protect and how they should protect it, including:

  • Computer software, including source and object code
  • Literary works
  • Motion pictures
  • Music
  • Online web content
  • Sound recordings

A copyright owner has the exclusive right to reproduce, distribute, perform, display, and license a protected work. When the work is infringed our copyright infringement lawyers can help our clients evaluate the most efficient means to remove the infringing work or deal with allegations of infringement, by sending a cease & desist copyright infringement letter or responding to one. The United States Copyright Act (17 U.S.C. Section 101 et seq.) provides damages for even allegedly unintentional infringement, attorneys fees, and when a work is knowingly infringed, a court may award enhanced statutory damages.

Digital Millennium Copyright Act (DMCA)

In addition to the criminal provisions, the DMCA increases the penalties for copyright infringement when it occurs on the Internet. The DMCA also provides an exemption from liability for ISPs (Internet service providers) and other content intermediaries. Our lawyers know how to leverage the Digital Millennium Copyright Act (DMCA) to remove infringing content, or how to help clients comply with the safe harbor provisions when receiving a notice of infringement.
