Biography

Scott’s practice at DBL is diverse and varied. He often serves as general counsel to businesses, reviewing contracts for goods and services, representing companies in commercial litigation disputes, and developing employee policies and handbooks.

Prior to DBL, Scott represented employers and insurers in workers’ compensation matters before the Virginia Workers’ Compensation Commission, advising clients on legal exposure and settlement strategy, and drafting key filings, discovery, and agreements in compliance with statutory requirements. Prior to that, he served as an Assistant Attorney General in the Civil... Litigation Division of the Virginia Office of the Attorney General, where he represented the interests of Virginia’s citizens and small businesses in regulatory proceedings involving public utilities and insurance. In that role, he handled complex litigation before the State Corporation Commission, negotiated favorable outcomes in multimillion-dollar rate cases, and provided legislative analysis on proposed bills impacting consumers. Earlier in his career, Mr. Herbert clerked for the Sixth Judicial Circuit of Virginia, conducting legal research and drafting judicial opinions on a broad range of civil and criminal matters.

Scott has experience with local tax issues, including sale and real estate taxes, the Virginia Clean Economy Act, contract disputes, environmental compliance, and the Virginia Human Rights Act.

Scott attended graduate school at the College of William & Mary. He earned his J.D. from William & Mary Law School, where he was a fellow at the Center for the Study of Law and Markets, and his M.B.A. from the Raymond A. Mason School of Business.

Scott enjoys chasing waterfalls. He thru-hiked the Appalachian Trail in 2016 and currently helps maintain it as a member of the local chapter of the Appalachian Trail Conservancy.
