Biography

Chuck Cantine is a partner in the firm’s litigation practice, focusing on patent, trademark, trade secret, and other intellectual property litigation. Chuck has extensive experience as a first-chair trial attorney, having successfully taken numerous IP-related cases through jury trial, and has served as trial counsel before federal and appellate courts throughout the United States.

In addition to his litigation experience, Chuck provides substantial counseling on intellectual property matters, including advising clients on the development and management of international and domestic intellectual property portfolios involving patents, trademarks, and trade secrets to protect his clients’ research and development activities, commercial products, and strategies. He also advises his clients on freedom-to-operate matters, including providing validity and noninfringement opinions and conducting due diligence investigations and competitor portfolio analyses.

Experience

  • Secured a permanent injunction and jury verdict of more than $60 million, one of the largest trademark verdicts ever, for PODS Enterprises LLC, as first chair in a trademark infringement jury trial relating to portable moving and storage containers. The case settled while on appeal for more than $40 million, with the permanent injunction remaining in place. The National Law Journal ranked this matter as the largest trademark verdict of 2014.
  • Obtained a jury verdict of infringement and fraud and an award of more than $70 million for XpertUniverse while serving as first chair in this two-week jury trial. The National Law Journal ranked it among the top 5 intellectual property verdicts in 2013.
  • Represented Richards Manufacturing in a theft of trade secret and breach of duty of loyalty case relating to rubber injection molding processes for high-voltage underground electrical connectors. Served as second chair in this five-week jury trial, after which the case settled.
  • Represented Axcess in a patent infringement action on two patents relating to active radio frequency identification (RFID) technology for container tracking.
  • Represented PODS in a trademark infringement action relating to portable moving and storage containers.
  • Represented Synthes in a patent infringement action on three patents relating to bone plates for fracture fixation.
  • Represented Digital Angel in a patent infringement action on a patent relating to passive RFID technology for companion animal tracking.
    Represented Gemstar (third-party defendant and counterclaim plaintiff) in a patent infringement action on three patents relating to on-screen program guides.
  • Represented Paradise in a patent infringement action relating to ink composition for use in erasable markers.
  • Represented Fuji in a patent infringement action relating to plastic injection molding processes.
