OVERVIEW

Resolving AI disputes before they become business problems

Most AI disputes start small. An employee pastes a trade secret into a public chatbot. A customer asks where the training data came from. An investor challenges a product claim. A regulator opens a file on marketing copy. A contracting officer asks how the AI in a deliverable actually works, and the False Claims Act sits behind the question.

We handle these matters from the first demand letter through trial, arbitration, or settlement. Winning matters. So does keeping the evidence intact, keeping confidential information confidential, answering the regulator on time, and keeping the business running while the case goes on. More than one company has won the case and lost the customer.

Our experience in AI litigation and dispute resolution

An AI dispute is rarely one kind of case. A trade secret claim turns into a data rights question, which turns into a procurement problem. Our litigators work the same matter with the firm’s intellectual property, government contracts, commercial, privacy, cybersecurity, and regulatory lawyers rather than handing it across a hallway. Through the Alliott Global Alliance we coordinate litigation and regulatory strategy in the European Union and the United Kingdom.

But our experience with AI privacy and cybersecurity goes beyond advising clients on the law. We develop, test, and deploy AI tools in our firm under confidentiality and governance controls, and we evaluate third-party platforms against confidentiality obligations. That means we evaluate AI privacy and security questions from both a legal and an operational standpoint, and we know which controls tend to survive contact with the engineers and business teams who have to implement them.

We also know how the systems work. Our attorneys have built and deployed AI tools inside the firm, so we understand the governance and confidentiality controls that end up at the center of most AI disputes.

What we do

AI disputes move fast, and the decisions made in the first week usually decide the case. We help businesses get those decisions right.

Early case assessment and emergency response
    • Respond to cease-and-desist letters, demand letters, preservation notices, subpoenas, and civil investigative demands
    • Preserve evidence, protect privilege, and contain the disruption in the first days of a dispute
    • Retain forensic experts and technical consultants early

    Commercial and contract disputes
    • Represent clients in mediation, arbitration, trial, and appeal
    • Litigate claims over AI performance, licenses, warranties, indemnities, and contractual representations
    • Handle disputes over autonomous and agentic systems, including liability allocation and human oversight

    Intellectual property litigation
    • Copyright, trademark, patent, and trade secret cases involving AI
    • Disputes over AI-generated content, training data, proprietary datasets, and machine learning inventions
    • Cases involving executive impersonation, payment diversion, deepfakes, and synthetic media
    • Defend allegations of AI capability misrepresentation and “AI washing”

    Government investigations and enforcement
    • Represent clients before federal and state agencies on AI compliance and automated decision-making
    • Respond to FTC, SEC, DOJ, and state attorney general inquiries into AI practices and capability claims
    • Represent contractors in procurement disputes, False Claims Act investigations, suspension and debarment, and bid protests involving AI requirements

    Internal investigations and litigation readiness
    • Build litigation readiness, discovery, and investigation protocols for organizations using AI
    • Conduct privileged internal investigations involving AI systems and AI-enabled processes
    • Investigate unauthorized use of AI, and disclosures of confidential information, source code, controlled unclassified information, or proprietary data to AI tools
