OVERVIEW

Protecting your brand

Federally registered trademarks can be an effective way to protect a business name, logo, and advertising and promotional investments. However, trying to protect registered marks can also give rise to complex, costly, and time-intensive disputes.

Dunlap Bennett & Ludwig represents businesses in matters that include trademark infringement, unfair competition, trade dress infringement, dilution, counterfeiting, false advertising, online infringement, cybersquatting and domain name issues, and merchandising and licensing disputes.

Our experience in trademark disputes

Dunlap Bennett & Ludwig’s trademark litigators have represented numerous domestic and international companies, including small startups and large corporations, in thousands of trademark law matters before federal district courts and the Trademark Trial and Appeals Board (TTAB). We have successfully litigated false advertising claims under the federal Lanham Act and false advertising and unfair business practices claims under state law.

Our trademark lawyers have decades of collective experience. Some of our lawyers are former U.S. Patent and Trademark Office (USPTO) trademark examiners, and some of our former lawyers work as examiners at the USPTO now. In 2019, we were voted one of the Top 100 Intellectual Property Law Firms in the United States by IP Watchdog.

What we do

  • Help businesses register trademarks
  • Perform trademark searches, monitoring, and docketing
  • Weigh the pros and cons of pursuing a trademark infringement case in federal district court as opposed to the TTAB
  • Represent businesses in trademark litigation cases in federal and state courts
  • Handle cancellation, opposition, and concurrent use proceedings, settlement negotiations, and ex parte appeals of final refusals by trademark examiners before the TTAB and World Intellectual Property Organization (WIPO)
  • Seek temporary restraining orders, preliminary injunctive relief, and permanent injunctive relief to stop trademark infringement
  • Advise on the settlement of trademark disputes when appropriate
  • Counsel on advertising, branding, and other trademark use to reduce the risk of future liability
