Our experience with internet and eCommerce law

Dunlap Bennett & Ludwig’s internet and eCommerce lawyers have extensive practice defending and prosecuting internet service providers, internet security firms, cloud-based SaaS companies, app service providers, A/V web streaming companies, and hardware and software developers in both the private industry and government space. Our law firm represents clients across technology sectors and regarding different intellectual property issues, including infringement, contract disputes, and data privacy law and related trade regulations.

Our intellectual property team has worked on domain name registration procedures, hosting agreements, online contracting and digital signatures, and click-through agreements. We have represented domain name brokers and trademark holders in the process of domain name sales, auctions, escrow, and brokerage. Our lawyers have also successfully litigated domain disputes under the Uniform Domain Name Dispute Resolution Policy (UDRP) and cybersquatting and infringement actions in federal and state courts.

What we do

  • Defend and prosecute in connection with internet and eCommerce disputes on online platforms, including websites, social media, online marketplaces, and file-sharing platforms, including URDP arbitration with demonstrated expertise in ICANN (Internet Corporation for Assigned Names and Numbers) operations
  • Draft and negotiate web development, software development, online partnership, and related contracts
  • Negotiate and ensure compliance with eCommerce contracts
  • Draft terms and conditions and privacy policies to protect the legal rights of site owners
  • Counsel clients in matters involving domestic and international data privacy laws, including compliance issues arising under the Children’s Online Privacy Protection Act (COPPA), the Controlling the Assault of Non-Solicited Pornography and Marketing Act (CAN-SPAM), the California Consumer Privacy Act (CCPA), the EU General Data Protection Regulation (GDPR), and the Telephone Consumer Protection Act (TCPA)
  • Represent clients in disputes arising under the Electronic Communications Privacy Act (ECPA) and the Computer Fraud & Abuse Act (CFAA)
