Since we began in 2001, Dunlap Bennett & Ludwig’s attorneys have worked diligently to help minority- and women-owned businesses. Those businesses may have an edge when submitting bids for certain federal government contracts. In particular, minority- and women-owned businesses may take advantage of the Section 8(a) program conducted by the Small Business Administration (SBA).

Who Qualifies For Section 8(a)

The SBA’s Section 8(a) Business Development Program offers assistance to businesses owned and controlled at least 51% by women and minority individuals. Only small businesses qualify; eligibility is determined by a cap on annual receipts, which varies by industry. The owner of the business must qualify as “socially or economically disadvantaged,” but the program presumes that most minority and women business owners will qualify. A minority or woman owner must manage the business on a day-to-day basis.

Under the Small Business Act, these individuals are presumed to be “disadvantaged”: African-Americans, Hispanic Americans, Asian Pacific Americans, Native Americans (American Indians, Eskimos, Aleuts, or Native Hawaiians), and subcontinent Asian Americans. A business can also qualify for the 8(a) BD program if the firm is owned by an Indian tribe, an Alaska Native Corporation (ANC), a Native-Hawaiian Organization (NHO), or a Community Development Corporation (CDC).
