Our team has initiated protests against assigned NAICS codes with the end goal to have the proper NAICS code assigned to that procurement. We have also commenced size protests against apparent awardees to require the SBA to determine whether the competitor is small under the size standard applicable to that procurement. In instances where the SBA has decided to apparent awardee is small, or where a size protest has been successfully brought against our client, we have appealed those determinations to the SBA Office of Hearings and Appeals (OHA) and zealously sought the lower decision to be overturned. In those instances where our client has been rightfully found small at the SBA level, but our client’s competitor has appealed that determination to OHA, we have aggressively defended our client and the SBA’s determination.
